While a growing number of firms are being evaluated on environment, social and governance criteria by sustainability rating agencies, comparatively little is known about companies’ responses. Drawing on semi-structured interviews with companies operating in Italy, the present paper seeks to narrow this gap in current understanding by examining how firms react to ESG ratings, and the factors influencing their response. Unique to the literature, we show that firms may react very differently to being rated, with our analysis yielding a fourfold (...) typology of corporate responses. The typology captures conformity and resistance to ratings across two dimensions of firm behaviour. We furthermore show that corporate responses depend on managers’ beliefs regarding the material benefits of adjusting to and scoring well on ESG ratings and their alignment with corporate strategy. In doing so, we challenge the idea that organisational ratings homogenise organisations and draw attention to the agency underlying corporate responses. Our findings also contribute to debates about the impact of ESG ratings, calling into question claims about their positive influence on companies’ sustainability performance. We conclude by discussing the wider empirical, theoretical and ethical implications of our paper. (shrink)

This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

This paper reports a European Forum for Good Clinical Practice workshop held in 2011 to consider a research ethics committee training syllabus, subsequent training needs and resources. The syllabus that was developed was divided into four competencies: committee working; scientific method; ethical analysis and the regulatory framework. Appropriate training needs for each, with possible resources, were discussed. Lack of funding for training was reported as a major problem but affordable alternatives were debated. Strengths and weaknesses of this approach were discussed (...) and the resultant proposal will be disseminated through the European Forum for Good Clinical Practice and the research ethics committees of member states. Se define “iatrofilosofía” como la disciplina traslacional entre la medicina y la filosofía que tiene un doble objetivo, teórico y práctico. Se presenta un modelo de iatrofilosofía práctica aplicado al dolor crónico asociado a depresión y estrés —depresalgia— que expande al ámbito médico general la psicoterapia Fenomenológica, Hermenéutica Dinámica (PHD). Se parte del modelo general de la triada médica — patología (disease), padecimiento (illness) y condición de enfermo (sickness)— y, en el horizonte de la antropología de Ortega, se proponen cinco (...) metáforas nucleares: avaricia del cuerpo, angustia de circunstancia, desgarro personal, nudos personales y expropiación personal. Estas se relacionan con los mecanismos neurobiológicos de sensibilización central, alostasis y alteración del eje hipotálamo-hipófisis-suprarrenal. Se propone un proceso de recuperación personal basado en la concordia terapéutica. El análisis del dolor crónico y de otros problemas complejos de salud puede beneficiarse de metodologías filosóficas como la hermenéutica clínica. (shrink)

Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. High-quality arguments have strong and lasting persuasive effects, suggesting that people can distinguish high- from low-quality arguments. However, we know little of what norms people employ to make that distinction. Some studies have shown that, in evaluating arguments from consequences, people are more sensitive to differences with respect to the desirability of these consequences than to differences in the likelihood that these consequences will occur. This raises the question of whether people lack the criteria to distinguish high-quality from low-quality arguments (...) in support of such claims. In an experiment, 196 participants without any training in argument theory rated their acceptance of 30 claims about the likelihood that a certain outcome would result from a certain action. These claims were supported by an argument from authority, or from cause to effect, or from example. Arguments were systematically manipulated to violate nine specific criteria. For seven out of the nine criteria violation decreased acceptance of the claim supported. These findings show that people can use argument type specific criteria to distinguish high- from low-quality arguments. (shrink)

The volume gathers theoretical contributions on human rights and global justice in the context of international migration. La diffusione del libro nel Medioevo potrebbe essere riletta alla luce di una metafora attuale sebbene non scevra di aspetti dialettici: quella della “rete”. All’ubicazione spazio-temporale del libro nei monasteri medievali, contraddistinta da fisicità e permanenza, si sotituisce oggi un formato digitale e virtuale, che porta ad una sorta di decontestualizzazione e alla continuità del flusso di informazioni, contribuendo alla diffusione capillare del sapere. L’ottica di universalità e globalità accomuna tuttavia entrambe le epoche. Alcuni concetti-chiave dell’informatica potrebbero infatti declinarsi in (...) ambito medievale: Server-Client per la raccolta, la conservazione e la trasmissione delle conoscenze da parte dei monasteri, quali centri del sapere in Europa, agli uomini di cultura; Firewall , per alludere alla necessità di tutelare i manoscritti, mediante la copiatura e la diffusione dei codici; Community , ad indicare non solo la comunità religiosa o monastica in senso stretto, bensì l’apertura ad una costruzione del sapere mediante un’azione partecipativa . I problemi dell’autenticità delle fonti, dell’acriticità delle informazioni e la pratica delle citazioni trovano un precedente significativo nelle Sententiae di Pietro Lombardo: una sorta di “biblioteca virtuale” grazie alla collezione di passi dalla Sacra Scrittura e da fonti latine e greche, paragonabile a un moderno modello enciclopedico di sapere. The diffusion of the book in the Middle Ages could be critically read through a modern metaphor: the “net”. The space-temporal coordinates of the book shift from being physical and permanent in the Medieval monasteries, to being de-contextualized and continue in the flow of information of digital and virtual format. However the universal and global perspective is common to the contemporary and the Medieval periods. In fact some key-words of computer science could be applied to the Medieval context: Server-Client , for the collection, the preservation and the transmission of knowledge from monasteries, as cultural centers in Medieval Europe, to men of culture; Firewall , for the necessary protection of manuscripts, through copying and diffusing codes; Community , referred not only to the monastic and religious groups, but also to an open sharing of the building of knowledge. Problems like the authenticity of the sources, the lack of criticality in the reception of data, and the practice of quotations are well represented in Peter Lombard’s Sententiae : this work can be compared to a modern encyclopedia thanks to the collection of passages from the Holy Scripture and from Latin and Greek sources, as well as a “virtual library”. O artigo aborda a diáspora forçada de africanos ao Brasil por fatores econômicos, políticos, sócio cultural e psíquico, desencadeado por ações do FMI e Banco Mundial. O tratamento desumano que recebem, o crescente número de crianças e adolescentes invisibilizados que sonham com um imaginário de vida melhor no Brasil, como o “pais do futebol”, e/ou uma passagem provisória para chegar ao primeiro mundo em países considerados de colonização europeia como EUA ou Canada. O artigo provoca reflexões sobre a força da (...) historia sobre o psiquismo e saúde mental humana a partir do ideário de uma pedagogia colonialista que sustenta a hegemonia do mundo capitalista. El currículo de Geografía e Historia en Secundaria.

Studying disorientation is studying how, through our bodies, culture and technology, we humans are connected to our environment, and what happens when this connection is weakened or severed. What happens, of course, depends again on our environment, bodies, culture and technology: the world around us becomes at times uncanny, unfamiliar or dangerous when we get disoriented. Disorientation can be exciting and refreshing—an invitation to explore, to leave behind nagging desires for control and certainty, and to embrace instead a more spontaneous (...) relationship with our surroundings. Getting lost shapes our consciousness, not only by transforming our perception of the world around us, but by transforming our sense of who we are in that world, and what possibilities are open to us within it.In this chapter, we analyse the phenomenology of disorientation to elucidate the role that emotions play in distributed cognitive processes that involve multiple agents and cognitive artefacts. The feeling of disorientation destabilises our horizon of experience and turns the world around us unfamiliar or alien. This feeling embodies our disconnection to the agents, the cognitive artefacts, and the environment around us. A proper analysis of the phenomenology of both orientation and disorientation uncovers the role feelings play in distributed cognitive processes: emotions serve as a form of evaluative regulation that contributes to, on the one hand, the syncing of the different elements of a distributed cognitive process, and on the other, to the eventual disengagement of the agent from an unreliable distributed cognitive process. Ocupa-se do problema do começo em filosofia e o relaciona com as dificuldades de pôr em curso o ensinar e o aprender a filosofar. Apresenta as tentativas de fundar um começo absoluto do pensar feitas por Descartes, Kant, Fichte, Hegel e Feuerbach, para, então, tratar do começo da filosofia e do pensar no pensamento problematizado por Deleuze.

Este artigo considera a marcante instabilidade da Filosofia nos currículos da Educação brasileira, assim como seu desaparecimento como disciplina, na versão aprovada da Base Nacional Comum Curricular. Apresenta as prováveis alterações que esse documento promoverá na Educação, referente à formação de professores, ao impacto político e à autonomia docente na criação de aulas, para, então, dedicar-se aos espólios filosóficos restantes na Base, sobretudo àqueles relativos à ética. Mostra que a dimensão ética atravessa o documento e está presente nas “Competências Gerais” (...) a serem desenvolvidas ao longo da Educação Básica, sendo, portanto, uma preocupação de todas as áreas do conhecimento, sobretudo no que se refere às Tecnologias Digitais de Informação e Comunicação e à sustentabilidade ambiental. Volta à definição de ética no documento e às suas bases, a saber, justiça, solidariedade e livre-arbítrio; problematiza seus sentidos e marca algumas incoerências. Evidencia que o documento, apesar de incentivar que a Educação dos jovens esteja, de um lado, voltada àquilo que fizemos e sabemos do mundo, por outro, para o aberto e indeterminado; dá ênfase excessiva à busca de soluções e ao aprendizado de respostas, dando prioridade, no que respeita à Filosofia, à resposta socrática para a questão “O que é o ser humano?” Destaca a ideia apresentada no documento de que o nosso tempo requer uma “nova mentalidade”, regida por uma “ética diferente”, e defende que é por meio do contato com modos de pensar filosóficos, presentes nos textos primários de Filosofia, trabalhados por professores habilitados para isso, que os estudantes tornar-se-ão competentes e hábeis nos dois principais sentidos éticos da Base – 1) da nossa relação com a natureza, com o Planeta e seus bens finitos; e 2) da relação consigo mesmo, o modo de ser. In the last decades the concept of objectivity has been criticized by the "new epistemologies". These criticisms favour the consolidation of relativist and subjective positions, which condition the objectivity of scientific knowledge to such an extent that it seems to be a goal impossible to achieve.

El libro centroamericano de los muertos de Balam Rodrigo es un retrato del terrible viaje que realizan los migrantes centroamericanos al pasar por México. Este oscila entre el verso y la prosa poética, así como en la narrativa, pues en ocasiones los poemas cuentan historias de muerte y desamparo de una persona en particular. Aunado a esto se encuentran los encabezados o extractos de notas periodísticas que titulan algunos poemas o se mezclan con los versos. Así, la naturaleza del libro (...) de Rodrigo es híbrida. Por ello en el presente artículo se analiza cómo es que el lenguaje perteneciente al mundo no-poético, se fusiona con los versos y crea metáforas y significados que van más allá de sus propias páginas. Lo cual hace que el lector sienta el dolor y angustia de los migrantes y se vuelva consciente de esta realidad. Esto se descubre al rastrear las fuentes originales de los extractos periodísticos, respetando el orden que da el autor. Como resultado se obtienen mapas espaciales y temporales, que exigen al lector conocer a fondo la causa que los propios versos gritan. (shrink)

RESUMEN Este artículo reconstruye la genealogia arendtiana de las formas extremas de la violencia, tomando como hilo conductor los procesos de desingularización con un doble propósito: por un lado, analizar las (dis)continuidades históricas de dicha genealogia que trasciende la dimensión fisico-instrumental de la violencia y entra conexión con la (des)configuración de la identidad personal; por otro lado, reivindicar la vigencia de la obra de Hannah Arendt para explorar los ecos presentes de esa violencia, sin perder de vista su especificad actual. ABSTRACT This paper reconstructs the Arendtian genealogy of the extreme forms of violence, taking desingularization processes as its guiding thread, with a twofold goal: on the one hand, to analyze the historical (dis)continuities of that genealogy, that goes beyond the physical-instrumental dimension of violence and comes into connection with the (de)configuration of personal identity; on the other hand, to claim the validity of Arendt's work to explore the echoes of that violence, without losing sight of its current specificity. : This article presents a definition of action that links empirical facts with normative reasons to form an explanation of rational agency with predictive capabilities. This idea is developed along the lines of pragmatism which holds that a set of beliefs is a matter of linguistic evaluation from a particular community. This notion is related to the idea of facts as empirical information that is cognitively apprehended. Such information is regarded as an input which is later contrasted to expected behavioral (...) responses from the agent. The deviation of such observed behavior with respect to the expected one represents an evaluative output that is understood as the definition of reasonably expected behavior. Action is, thus, understood as the outcome of such an evaluative process. (shrink)

The objective of this paper is to reflect on the proper way for Christians to do philosophy, in respect of which I have been inspired by a phrase attributed to Cardinal Newman: “We do not need Christian philosophy. We need Christians making good philosophy.” This sentence can appear controversial, but I believe it is not, if its content is made explicit in an appropriate way. To better develop what I understand Newman to be proposing here, I have added another category (...) to his statement, with the consequence that my own text falls into three sections: 1) on Christian philosophy; 2) on Christian philosophers; 3) on Christians who do philosophy. This is the scheme that we will use to position ourselves as regards the complex issue of the relationship between philosophy and Christianity. (shrink)

Trabajar en las aulas la memoria histórica, como temática controvertida y que suscita debate social, es un reto de la enseñanza de las ciencias sociales. A nivel global han sido innumerables las acciones desarrolladas para que se recupere la memoria de aquellas personas silenciadas durante décadas, unidas a conflictos sociales y políticos. Sin embargo, existen pocas investigaciones que analicen los recursos didácticos que ofrecen las tecnologías digitales sobre la temática. En este trabajo se identifican cinco apps que tienen como eje (...) el Holocausto y se analizan sus posibilidades educativas y su tratamiento de la memoria histórica. El resultado apunta a que estas apps no presentan una arquitectura didáctica adecuada y proponen una función principalmente informativa, aunque poseen características específicas que permiten su uso en contextos educativos si se hace un buen uso de sus funcionalidades a través de una mediación adecuada. Respecto a la memoria, aunque presentan un tratamiento basado en testimonios y recuerdos individuales, obvian la necesidad de una metodología deliberativa que permita confrontar ideas y fomentar una actitud crítica ante la historia institucionalizada. No es necesario postular en el hombre una fuerza especial para explicar determinados fenómenos cognitivos. Debería bastar la actividad cerebral para explicar cualquier actividad humana, incluida la activad cognitiva. Major proponents of both Distributed Cognition and Predictive Processing have argued that the two theoretical frameworks are strongly compatible. An important conjecture supporting the union of the two frameworks is that cultural practices tend to reduce entropy —that is, to increase predictability— at all scales in a cultural cognitive ecosystem. This conjecture connects Distributed Cognition with Predictive Processing because it shows how cultural practices facilitate prediction. The present contribution introduces the following challenge to the union of Distributed Cognition and Predictive (...) Processing: the problem of entropic cultural practices. The problem lies in the existence of multiple cultural practices that tend to increase entropy instead of reducing it. This paper discusses these entropic cultural practices and the nature of the problem at hand. Finally, the paper advances an expanded conception of cultural practices that could unite the two frameworks and explores the difficulties of committing to such a conception. (shrink)

Interpretando a Nietzsche, podríamos afirmar que la embriaguez dionisíaca le posibilita al humano dirigirse afectivamente hacia lo externo, borrando incluso y paradójicamente ese límite que determinaría dónde empieza su ser y dónde aquello a lo que su ser es empujado. Trías recoge esta determinación en un concepto clave de su filosofía al denominarnos “ser del límite”. En ambos filósofos somos radicalmente pasión creadora; somos un animal límite y caótico, sufriente por queriente, y potencialmente feliz por el mismo motivo.
